Commission's investigative powers Commission's investigative powers
(1) The commission may exercise the same powers as a court in accordance with the prevailing law in carrying out the following tasks while investigating in accordance with this Act:-
(a) to bring any person before the Commission to obtain information or make a statement,
(b) To understand the witness and make a statement,
(c) to order the production of any writ or document,
(d) Extracting any document or its copy from any government or public office or court, but when extracting such document from any court, the permission of the relevant court must be obtained.
(e) Understanding Evidence,
(f) To conduct or cause on-site inspection or to order the submission of evidence.
(2) If the witness or any other person cannot be brought before the commission for reasons of security or other reasons, the commission may make the statement of such witness or person through audio-visual dialogue (video conference) or any other means.
(3) In accordance with sub-section (1), the Commission may fix a reasonable time if it deems it appropriate to make a person appear or to submit a document, document, document or evidence.
(4) If the Commission believes that any article or document related to its investigation is with a person or in a particular place, without notice, to search such person or place, and to seize or cause to be seized the article or document found, or to make a full or partial copy of such document. (5) If any person holding a public position is investigated in accordance with this Act and if it is found that he is likely to falsify evidence while in office, the Commission may send a written notice to the relevant body to suspend him and if such a letter is received, the related body may also notify such person regarding his service conditions. If it is mentioned in the law, it should be suspended for a maximum of three months if it is not mentioned in that way.
(6) If the commission is convinced that the body of the missing person has been buried in a place, the commission can excavate the place and find out the truth.
(7) Sub-section (6)Excavation should be carried out in a systematic manner and if a body or remains of a person is found during such excavation, the Commission will, as far as possible, take the DNA of such a body. Or if such body or remains are available to a family member of the deceased after conducting an autopsy, they should be handed over to him.
(8) Other arrangements related to investigation of complaints and information received by the Commission shall be as prescribed.
